The following are terms of a legal agreement between you and SPB TV AG. By accessing, browsing, or using this Service, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations, including export and re-export control laws and regulations. If you do not agree to these terms, please immediately cease to use this Service.
SPB TV AG may, without notice to you, at any time revise these Terms of Use and any other information contained in this Service. SPB TV AG may also make improvements or changes in the products, services, or programs contained in this Service at any time without notice.
1. DEFINITIONS
"Terms of Use" means these Terms of Use all the provisions that you have agreed to in connection with the use of the Services.
"Content" means all audiovisual, cinematographic, textual, literary, audio, graphic, typographic and photographic elements, software, databases, applications, animated images, etc. available in the Services, including the Audiovisual Content offered through the Player.
"Player" means the computer tools for broadcasting and reading Content on the Sites.
"Service (s)" refers to, without this list being limited, websites (including www.spbtv.online, beltandroadtv.ru, cn.spbtv.com and others), services, and applications (SPB TV, Belt and Road TV and others).
"User" means any natural person who has fulfilled the conditions of access to the Service for the purpose of accessing the Content.
2. SUBJECT
These Terms of Use are terms of a legal agreement between you and SPB TV AG regarding the access and use of the Services.
3. USE OF SERVICES AND REGISTRATION
Use of Services is always subject to acceptance of these Terms of Use.
Access to Services is free, but access to certain sections of Services (paid subscriptions) requires the purchase of the subscription.
Registration in the Services is voluntary.
You agree not to use a pseudonym or email address that could infringe the rights of third parties (including use of the surname, pseudonym, trademark, trade name of others, or works protected by copyright and / or a neighboring right).
In case you are registered with username (and/or email address) and password, such information is personal and confidential. You are solely responsible for the use of your password. You agree to keep your password secret and not to disclose it in any form whatsoever.
In the event that you are a minor, you represent and acknowledge that you have obtained authorization from the parent (s) of your parental authority to register and use the Services.
4. AVAILABILITY OF SERVICES
The use of the Services requires a high speed Internet connection, adequate computer equipment and/or supported by the Service device (smartphone, tablet, etc.) all costs, fees, subscriptions and taxes are independent of the Services offered by SPB TV and are your exclusive responsibility.
You agree not to interfere with the operation of the Services in any way whatsoever and in particular not to use any computer program intended to interfere with the normal work of Services.
5. INTELLECTUAL PROPERTY
5.1. Services
The Services, including all texts, illustrations, videos, images, sounds, data, databases and programs, including software technology, and other materials comprising the Service are protected by copyright and are owned by SPB TV or SPB TV is authorized to use it by corresponding copyright owners of such intellectual property.
Any hacking, copying, reproduction, republishing, uploading, posting, transmitting, distributing, or use for the creation of derivative works of the Services or its part and/or Content made available in the Services constitutes a breach of copyright.
5.2. Player
The Player, which allows viewing the Content on the Services, except for certain Content determined by SPB TV (if applicable), is the exclusive property of SPB TV.
It is prohibited to reproduce, copy, modify, alter, delete, exchange or exploit for any purpose, directly or indirectly commercially or for any remuneration, profit or advantage, direct or indirect, all or part of the Player and its Content.
Any backup or download, whatever the process or the medium used for this purpose, of all or part of the Contents is expressly prohibited.
Publishing, making available to the public or communicating to the public software, an application, website, etc. to bypass the normal use of the Player is not allowed.
5.3 Content Protection
The Content accessible by the User in the Services are digital files and streams protected by national and international provisions on copyright and related rights. They are exclusively reserved for private use.
Any use outside this framework is strictly prohibited, including the resale, exchange, rental of digital files and/or streams or their transfer to a third party. In particular, any full or partial reproduction, modification or use of the intellectual property rights included in the Services, for any reason and on any medium whatsoever, without the express prior agreement of SPB TV, is strictly prohibited.
The User agrees not to circumvent or interfere with the protection system of Services, nor to encourage third parties to perform such acts.
6. LIABILITY
SPB TV disclaims any liability for the use of the Services that does not comply with these Terms of Use.
Information in the Services is not promised or guaranteed to be correct, current, or complete, and the Services may contain technical inaccuracies or typographical errors. SPB TV AG assumes no responsibility (and expressly disclaims responsibility) for updating the Services to keep information current or to ensure the accuracy or completeness of any posted information.
SPB TV is not responsible for any delay in the execution or for any non-fulfillment of its obligations under Terms of Use resulting from force majeure.
7. SUSPENSION – TERMINATION
SPB TV reserves the right to temporarily interrupt all or part of the Services for reasons related to the security of the Services.
Your failure to comply with these Terms of Use, conditions, and notices on the Services will result in automatic termination of any rights granted to you and blocking of your access to the Services.
8. APPLICABLE LAW - COMPETENT JURISDICTION
You expressly acknowledge that only Swiss laws are applicable.
Before any referral to a jurisdiction, you agree to inform SPB TV of any difficulties or claims by emailing to support@spbtv.com.
In case of failure to resolve the problem by means of negotiations, disputes arising from the formation, interpretation or execution of these Terms of Use will be submitted to the competent courts of the canton of Zug, Switzerland.
